Lawsuits Seek to Silence Voters on Prop. 8

California has voted-twice-to define marriage as the union between one man and one woman. California Gov. Arnold Schwarzenegger has vetoed-twice-legislation that would have legalized same-sex "marriage."But three lawsuits sitting at the California Supreme Court argue none of that matters.After Proposition 8 won 52 percent of the vote last week, the American Civil Liberties Union, Lambda Legal and the National Center for Lesbian Rights rushed their lawsuits to the state's highest court.Their contention: The marriage-protection amendment to the constitution is unconstitutional.Bruce Hausknecht, judicial analyst for Focus on the Family Action, said the California Supreme Court rejected an identical claim in July. "Nothing new has been raised in these lawsuits that suggests a different outcome," he said. "Even the four activist justices on the court who trampled the will of the people in May will have to follow the law this time and dismiss this frivolous challenge."Hausknecht said Schwarzenegger also is off-base in opposing Prop. 8."The governor's preference for the opinion of four activist judges rather than the 5.8 million citizens who voted for Prop. 8 boggles the mind," he said. "His ignorance of the constitutional roles of the courts vs. the people is especially alarming coming from the chief executive of the nation's most populous state."
