Victory in Daytona shows the rest of the country how it's done.The 11th Circuit Court of Appeals has ruled that Daytona Beach and other cities can use zoning and nudity ordinances to limit sexually oriented businesses.Local law enforcement said the businesses are responsible for a rise in crime. Scott Bergthold, an attorney who specializes in zoning ordinances, called the outcome a major victory. The court made it clear where the law draws the line."In addition to that, it also dealt a pretty strong blow to the main experts that adult businesses use all over the country," he said.Lawyers for the sexually oriented businesses are threatening to appeal all the way to the U.S. Supreme Court, but Bergthold said their efforts will likely be in vain."The big reason the Supreme Court is not likely to take the case," he said, "is that now this court of appeals is in line with all the other courts of appeals in the country in rejecting similar claims and rejecting these particular experts."Pat Trueman of the Alliance Defense Fund said the city now can enforce its ordinances freely."There's no question," he told Family News in Focus, "that particular strip club will have to relocate to the area that the city feels is the only appropriate area for them to be located."
